Is Stake.us Legal in the US? Find out which states are legal for Stake.us!

Last Updated on January 9, 2026
Fact checked by: David Genge

What states is Stake.us legal in? Quite a lot, actually – 33 to be exact. As it is a sweepstakes casino and not a real money betting site, Stake.us is far more widely available than you might think.

However, there are still seventeen states from where Stake.us cannot be accessed, including New York and Washington. Some states also have restrictions on prizes; however, the limits are so high that the average player shouldn’t be affected.

What states can you play Stake.us in?

This operator is a sweepstakes casino and not a social gaming site, meaning that it doesn’t need a license from each state in which it wishes to operate. As a result, it is far more widely available throughout the US than your average online sportsbook or casino.

In total, the Stake.us social casino is actually available in all but seventeen US states, which are Delaware, Washington, Kentucky, West Virginia, Connecticut, Nevada, Arizona, Louisiana, New York, Pennsylvania, Idaho, New Jersey, Michigan, Maryland, Montana, Rhode Island, and Vermont. Only users within the U.S. mainland and Hawaii are authorized to use the service. In all other locations, players aged 21 and older can legally play casino-style games for free on the site.

While you do have the opportunity to play completely free if you so wish, you can also make on-site purchases of Gold Coins. If and when you do, make sure to keep an eye out for specially-marked promotional packages that come with free Stake Cash.

Stake.us is one of the most widely available and best US social casinos. With 33 legal states in total, it is virtually impossible for us to speak about the specifics of each location. Fortunately, the availability of the service is largely the same in all locations. We have therefore just highlighted some of the notable legal locations below.

Stake.us NJ and Pennsylvania

New Jersey and Pennsylvania are two of the only US states where social gaming casinos are available. Many have therefore questioned if a sweepstake casino like Stake.us would be popular in these locations.

However, a sweepstakes casino isn’t just an alternative for players in locations where real online gaming is not an option. It also offers a fun and risk-free casino-style gaming experience for players who do not wish to put their own money on the line every time they want to play.

Stake.us California

The Golden State is known for its overall liberal approach; however, it still has strict laws in place regarding online gambling. Stake.us offers one of the best and closest legal alternatives to Californians who are looking for a casino-style experience online.

Stake.us Texas

Even in one of the most notoriously conservative states in the country, players aged 21 and older can access the Stake.us platforms. Surprisingly, there are no restrictions for players in Texas regarding prize redemption or bonuses – all areas of the site are accessible in the Lone Star State. In fact, Stake’s US office is actually located in Dallas, Texas.

Stake.us Georgia

Online sportsbooks might be legal in the Peach State, but real money casinos still remain prohibited. However, sweepstakes are perfectly legal according to state law, meaning that you have full access to Stake.us within its borders.

Stake.us North Carolina

There are a few land-based casinos in North Carolina, but when it comes to online casino-style gaming, social casinos are the only option. Naturally, Stake.us is among the best and most popular providers in the Tarheel State.

Stake.us Illinois

Online casinos remain prohibited in the Prairie State, but both social gaming and sweepstakes are perfectly legal. Therefore if you want to play slots and casino-style games in Illinois, this is your best option.

Stake.us Ohio

While it is known for having many land-based casinos and racinos, the online casino world has been restricted in Ohio. Nevertheless, online and mobile sweepstake casinos like Stake.us remain legal in the Buckeye State.

Stake.us Florida

Stake.us is completely legal in Florida, as are all social casinos. However, as is the case in New York, Florida does have a prize cap of $5,000 maximum that can be won on any single sweepstakes game or entry. As a result, prizes exceeding $5,000 in value cannot be redeemed by Florida residents.

What states can you not play Stake.us in?

Although it is legally available in the vast majority of the US, there are still six states where Stake.us cannot be accessed. Below, you can take a look at why each of these locations is restricted.

Stake.us Washington – Sweepstakes prohibited

The reason why Stake.us cannot be accessed by players in the Evergreen State is pretty simple. Washington (state) is the only US state with laws that effectively prohibit sweepstakes in the format through which Stake.us offers prizes. If you are looking for a casino-style gaming experience online in Washington, then you will have to turn to a social gaming-only site, such as BetRivers.net.

Stake.us New York

This operator might not be available in the Empire State, but there are some similar sites that are. Sweepstakes casinos are not illegal in New York, it’s just that Stake.us isn’t available yet. That being said, like Florida, NY state does also have a $5,000 maximum prize cap in place.

Stake.us Nevada

Naturally, this is the one that surprises most people. Despite being home to Las Vegas and being a state that is synonymous with casinos across the world, Stake.us and a is not available in Nevada.

Stake.us Michigan

Stake.us was previously available in Michigan, and there is nothing in the law to prevent it from being so. However, it was added to the list of excluded states in spring 2023. It remains excluded for the moment but may become available again in the future.

Stake.us Idaho and Kentucky

Finally, Stake.us is not currently accessible from the states of Idaho or Kentucky. Once again, there are similar operators available for players here, so we cannot rule out Stake arriving in these states sometime in the future.

At the end of the day, there is mostly good news here, as Stake.us is legally available in almost all US states. So long as you are aged 21 or older, and not located in one of the six excluded states, you can register an account and start playing casino-style games here for free. Furthermore, of the six excluded states, Washington is the only one where sweepstakes are prohibited by law. As a result, there is a realistic probability that Stake.us could become available in the other five in the future.
