New Jersey Imposes Mandatory Data-Driven Responsible Gaming Requirements

New Jersey is the first state in the USA to impose mandatory data-driven responsible gaming requirements for gambling operators in the state. State Attorney General Jennifer Davenport and the New Jersey Division of Gaming Enforcement (DGE) announced sweeping data-driven responsible gaming requirements on Tuesday. All of these requirements have been codified into state regulations with the force of law.
These moves will place the impetus on gambling operators in New Jersey to look out for the best interests of their players. The gambling sites will be responsible for assigning a designated lead person to handle responsible gambling initiatives and to quickly identify players who are developing a gambling problem and need help.
New Jersey is seeking to set the responsible gambling standard
By becoming the first state to take such strong measures to protect players from gambling harm, New Jersey is setting a standard for other states with legal and regulated sports betting to follow.
“New Jersey continues to lead the way in developing data-driven best practices for Internet gaming and online sports wagering," New Jersey Governor Mikie Sherrill said in a statement. “We continue to work to make the online world safer and to focus on safeguards that protect people’s well-being and help connect those who are struggling with the support they need.”
The regulations the DGE is imposing will establish clear baseline criteria for identifying problem gambling behaviors. They will also outline the assistance operators must provide through three specific phases of intervention.
In the process, New Jersey is strengthening its safeguards for gambling patrons. The state is also seeking to expand responsible gaming awareness and required action across the industry. These measures are designed to ensure that patrons who need help are identified by operators and receive timely, consistent, and effective support.
The onus for player safety is being placed on gambling site operators
New Jersey's new responsible gaming regulations will require that every operator appoint a responsible gaming lead. That person will be in charge of all responsible gambling efforts.
Operators must also implement a set of mandatory patron play thresholds and behavioral triggers. These measures will help identify patrons who may need support. When it is established that patrons meet those criteria, operators must engage in a due diligence review to determine whether the patron is exhibiting signs of potential problem gaming.
If so, the operator must add the person to the operator’s list of at-risk patrons. Next, the operator must apply three phases of interventions based on the operator’s assessment.
All New Jersey operators currently maintain responsible gaming staff. They abide by similar standards under previously established responsible gaming best practices. However, previously there was no uniform, regulatorily enforceable standard for when further review and phased intervention is required.
“We are proud to enact regulations that require operators to offer resources, including live support if appropriate, to those struggling with problem gambling,” Attorney General Davenport said. “We have a responsibility to keep the gaming industry accountable and ensure that help is available to those who need it.”
The responsible gaming regulations can be found online at the Proposed Rules section of DGE’s website.
New Jersey is introducing the RecoverMe App
Committing to assist those with a gambling problem, New Jersey is introducing the RecoverMe app.
Developed by physicians, the RecoverMe app aids individuals in gauging their gambling behavior. It uses validated assessment tools and provides flexible engagement in sessions based on evidence-based therapy. It also offers tracking systems for their gambling habits.
RecoverMe also contains additional New Jersey-specific services for individuals who are in crisis and need emergency support.
